7. Contract description
The general objectives of the Euromed Audiovisual II Programme are the development of the audiovisual sector in the Mediterranean Partners and fostering the emergence of a Euro-Mediterranean cultural identity. More specifically, its objectives are to develop co-operation among audio-visual operators in the region; to support training in the audiovisual sectors; to contribute to the preservation of Mediterranean audiovisual heritage; and to support the dissemination of cinema productions throughout the region and in the EU.
The objectives of this contract are: (i) to support the MEDA public authorities in charge of audiovisual policies in the field of audiovisual legislation, fight against piracy and protection of intellectual rights (through provision of studies, workshops and technical assistance); (ii) to monitor the other actions funded under the Euromed Audiovisual II Programme (in particular the projects selected following the call for proposals), to foster networking among them and to ensure visibility and dissemination of their results.

CONDITIONS OF PARTICIPATION
11. Eligibility
Participation is open on equal terms to all natural and legal persons of the EU Member States and of the MEDA Countries and Territories (Algeria, Egypt, Israel, Jordan, Lebanon, Morocco, Syria, Tunisia, Turkey and the West Bank and Gaza).
12. Offer
All eligible natural and legal persons (as per item 11 above) or groupings of such persons (consortia) may submit an offer.
A consortium may be a permanent, legally-established grouping or a grouping which has been constituted informally for a specific tender procedure. All members of a consortium (ie, the leader and all other partners) are jointly and severally liable to the Contracting Authority.
The participation of an ineligible natural or legal person (as per item 11) will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded.
Since this contract includes monitoring activities, any eligible natural and legal persons (as per item 11 above) involved in any other EuroMed Audiovisual II activity can not participate to this tender as contractor (leader or partner) or expert.
13. Number of offers
No more than one offer can be submitted by a natural or legal person (including legal persons within the same legal group), whatever the form of participation (as an individual legal entity or as leader or partner of a consortium submitting an offer). In the event that a natural or legal person (including legal persons within the same legal group) submits more than one offer, all offers in which that person (and legal persons within the same legal group) has participated will be excluded.
14. Grounds for exclusion
As part of the application form, candidates must submit a statement to the effect that they are not in any of the exclusion situations listed in Section 2.3.3 of the Practical Guide to contract procedures financed from the General Budget of the European Communities in the context of external actions (available from following Internet address: http://europa.eu.int/comm/europeaid/index_en.htm).
15. Sub-contracting
Sub-contracting is allowed up to a maximum of 20% of the contract value.
16. Participation to the tender
Candidates who want to receive the tender dossier have to send a request by fax (+32-2-29 21002) or by e-mail (EuropeAid-meda-tenders@cec.eu.int).
The request have to mention the publication reference of the procedure (pt.1) and the name, address, phone and fax number as well as the e-mail address of the organisation to which the Tender dossier has to be sent.
The tender dossier will be sent within one working day maximum following the receipt of the request.

36 months (an extension of maximum 12 months may be envisaged at a later stage of the contract)
SELECTION AND AWARD CRITERIA
19. Selection criteria
The following selection criteria will be applied to candidates. In the case of offers submitted by a consortium, these selection criteria will be applied to the consortium as a whole:
1) Economic and financial standing of candidate [based on item 3 of the application form]
(a) the average annual turnover of the candidate (for the Leader in case of Consortium) must exceed 1M€ per year in the last 3 years (2001-2002-2003) or management of similar budget in case of public entities, NGOs etc.
2) Professional capacity of candidate [based on items 4 and 5 of the application form]
(a) at least 5 permanent staff is currently working for the Leader of the consortium in fields of project management and backstopping.
(b) at least 5 permanent staff is currently working for the candidate (all partners in case of Consortium) in the specific fields of this project (audiovisual, communication activities).
3) Technical capacity of candidate [based on items 5 and 6 of the application form]
(a) the candidate has implemented at least three projects in the specific fields of this project (audiovisual, communication activities) in the last five years;
(b) the candidate (or the leader in case of a consortium) has implemented at least two projects regarding the management of External Aid co-operation project or programmes of a value of at least 1M€ in the last five years;
If more than 8 eligible candidates meet the above selection criteria, the relative strengths and weaknesses of the applications of these candidates must be reexamined to identify the eight best offers for the tender procedure. The only factors which will be taken into consideration during this re-examination are:
1) Experience in managing project/programmes in the Mediterranean region
2) Number of executed projects in the specific fields of this project

The most economically advantageous technically compliant offer.
